CHARLESTON - A Scott Depot couple is suing after a slip and fall at Golden Corral.
Joyce McCormick-Arthur and David Arthur filed the lawsuit June 30 in Kanawha Circuit Court against PJL Enterprises, dba Golden Corral.
Joyce alleges that she slipped on a puddle of water while eating July 16, 2004, at the Golden Corral in Cross Lanes.
"While on the defendant's premises, Plaintiff… slipped on water that had collected on the floor in the defendant's main dining room, which caused her to fall to the ground and suffer significant injuries," the lawsuit says.
The Arthurs blame Golden Corral for allowing the condition to develop and not warning them of it.
Joyce says she "suffered serious bodily injury and tremendous pain and suffering, loss of wages, loss of earning capacity, loss of ability to perform household services, loss of ability to enjoy life, humiliation, embarrassment, annoyance and inconvenience as well as other economic and non-economic damages, which losses she will continue to suffer into the foreseeable future."
Robert Warner of Warner Law Offices in Charleston is the plaintiffs' attorney.
David says he has lost consortium and the society and comfort of his wife. They are seeking compensatory damages and court costs.
Judge Jennifer Bailey Walker has been assigned the case.
