MORGANTOWN - A Morgantown couple has filed a lawsuit over a car accident.
Kathryn and Harlan Trickett entered the suit July 7 into Monongalia Circuit Court against Evan Tusa and All State Insurance Company.
They claim he is to blame for a collision that occurred July 8, 2004, on South University Ave. in Morgantown.
The original claim has already been settled. Now the Tricketts are seeking underinsured motorist insurance coverage compensation from All State.
She says she was driving a 2003 Chevrolet Impala and was stopped at a red light near the Radisson Hotel. When it turned green, she attempted to make a left. However, she says Tusa ran his red light and crashed into her car.
Trickett also seeks compensation for: Pain, suffering and mental anguish, past, present and future; past and future medical bills; lost wages and earnings; and the loss of the ability to enjoy life.
She also seeks to recover court costs. Harlan Trickett claims he has lost the comfort, society, companionship and consortium of his wife.
Morgantown attorney Wesley W. Metheney of Wilson, Frame, Benninger and Metheney is representing the plaintiffs.
