Woman says she fell in water hole

MARTINSBURG - A Martinsburg woman is suing the City of Martinsburg after she claims she fell on a broken water meter cap.

Amber Davidson filed the lawsuit July 5 in Berkeley Circuit Court, claming "the removable metal cap… had not been secured properly, and when Amber stepped onto it, the cap rotated within the metal frame surround it and Amber fell into the hole beneath and injured herself."

The alleged incident occurred July 6, 2004.

"Martinsburg owed a duty to Amber to keep its aqueducts and viaducts in repair," the complaint says.

Davidson says she has suffered: Property loss, lost wages and physical and emotional injury and in the future will continue to suffer great physical and emotional pain.

She is seeking compensatory damages.

Judge David Sanders has been assigned the case.
