* Bannan claims he allowed Dougherty and Quality Optical to purchase items using several bank and credit cards. After each sale, he was sent a bill. He eventually was sent a series of bills totaling $58,653.84 for which Quality Optical failed to compensate him. Bannan claims he has incurred damages in the amount of $47,153.84 and is seeking that amount for compensatory damages.

* The Zaleskis claim they paid $4,100 to purchase building supplies for Eberhart. Soon after, the defendant began positioning bricks and mortar and then suddenly abandoned the job leaving it unfinished. They say the defendant never returned, and the Zaleskis were forced to pay an additional $1,806.56 for the supplies. They claim breach of contract, negligence, fraud, and a violation of the West Virginia Legislative Rules and the West Virginia Consumer Protection Act. They are seeking compensatory damages, attorney fees and other costs and expenses.
