MORGANTOWN - A Monongalia County man says Superior Ford Lincoln Mercury of Morgantown lied about the history of a car he purchased.
Kenneth Jeffries is also suing Americredit Financial Services in a lawsuit filed Aug. 15 in Monongalia Circuit Court.
The complaint says Jeffries purchased a used 2005 Chevrolet Cobalt on April 4, 2006, for more than $15,000.
"At the time of the sale, Superior expressly warranted that the Cobalt had not been wrecked," the complaint says. "The day after purchase… the plaintiff notice a wobble in the front end."
Jeffries says he took the car to Superior for repairs on April 14, and the car was kept there until May 4 when it was taken to University Motors.
It was discovered that the radiator and radiator support and fan shroud were all out of position and damaged, Jeffries said. He adds that a bad pull to the right was caused by an accident.
Jeffries says he has revoked his acceptance of the car, and Superior currently possesses it. He wishes to recover the costs of the purchase and be awarded compensatory damages for annoyance and inconvenience.
He also seeks punitive damages and attorneys fees.
"Superior lied to the plaintiff. Superior knew it lied," the complaint says. "The plaintiff relied upon the lies by Superior in buying the Chevy Cobalt."
Americredit is listed as a defendant because it is a holder of the purchase contract.
