Company seeks payment

CHARLESTON - A Waverly-based company is seeking payment for services provided to a Wisconsin-based company.

IVS Hydro, Inc. is suing Midwest H2O Filter Rehab Specialist in Kanawha Circuit Court, claiming that the company's owners, Janet and Dennis Kull of Oshkosh, did not pay IVS then changed their company's name to avoid it.

In a lawsuit filed Aug. 8, IVS alleges also that Midwest H2O entered into the contract with the knowledge that it could not pay it.

In 2005, IVS Hydro says it performed certain works at projects in Ashtabula, Ohio; Connelsville, Pa.; Detroit; Richton Park, Ill.; and Roanoke, Va.

IVS uses hydro demolition to remove concrete and other materials.

When IVS attempted to contact the Kulls, it says they "changed the name of their business with the intention of avoiding their debts and obligations to the plaintiff."

Martin Smith of Charleston law firm Smith and Thompson is representing the company, which is seeking $74,900 in compensatory damages, as well as punitive damages and court costs.

Judge Charlie King has been assigned the case.
