CHARLESTON - Attorney James Barber filed two asbestos cases last week in Kanawha Circuit Court.
Barber, of the Law Office of James M. Barber in Charleston, is representing Vernor and Lorraine Sartin and Harry and Louise Eyler.
Both Vernor Sartin and Harry Eyler claim in lawsuits filed Aug. 18 to be stricken with mesothelioma as a result of years of exposure to asbestos while working in West Virginia.
Sartin, 81, currently lives in Brinkley, Ark., and Eyler, 85, lives in Steubenville, Ohio.
Sartin's case names 50 defendants.
"The illness and disability of Vernor Sartin is a direct and proximate result of the negligence, recklessness and willfulness of asbestos defendants in that they produced, used, sold and otherwise put into the stream of interstate commerce asbestos and asbestos-containing materials which asbestos defendants knew were deleterious, poisonous and highly harmful to Vernor Sartin's body, lungs, respiratory system, skin and health," the complaint says.
Eyler's case names 89 defendants. It says he was diagnosed with mesothelioma in July 2005.
West Virginia corporations Nitro Industrial Coverings, Famous Furnace and Supply, UB West Virginia and Vimasco Corp. are named as defendants in both suits.
Both men's wives are suing for loss of consortium. The lawsuits seek compensatory and punitive damages.
A visiting judge will be assigned both.
