CHARLESTON - A woman who says she was injured while working at Charleston Newspapers has filed another lawsuit against the company, claiming it is to blame for her fall.
Judith Terry filed the lawsuit Aug. 17 in Kanawha Circuit Court against Daily Gazette Company, which publishes the daily newspapers Charleston Daily Mail and Charleston Gazette.
She says a previous case was dismissed without prejudice, allowing her one year to file it again.
On Oct. 25, 2002, she says she was injured because of faulty flooring.
"Petitioner states that as a result of the defective flooring in the workplace, she was thrown to the floor when her chair tripped over due to the defective condition of the flooring," the complaint says.
Dunbar attorney Eunice Green is representing Terry.
Terry adds that her injuries lasted more than three years, and that it wasn't the first time the flooring tripped her up.
"Respondent was aware that such defective condition was of such a degree that the petitioner had suffered injuries previously due to the same defective condition," the complaint says.
"Petitioner's injuries are serious and have lasted more than three years. The seriousness of Petitioner's injuries are such that she continues to experience severe pain and is still receiving medical treatment for her injuries."
She seeks compensatory damages in excess of $50,000, as well as punitive damages.
Judge Irene Berger has been assigned the case.
