* Smith was injured in an automobile accident on Sept. 18 and is in a coma at CAMC. Her vehicle was hit by a Rock Branch Mechanical van driven by Willie Taylor. The plaintiff seeks an order to enjoin the respondent from removing the van from its location in Poca until it can be inspected thoroughly; from destroying, damaging or tampering with the event data recorder or from downloading information from that recorder without the presence of representatives of the petitioner; and from damaging, destroying, defacing, altering or disposing of any dispatch records or driver service logs for the 24-hour period prior to the accident.
