MARTINSBURG - A woman says she was injured while shopping at Carpet World and has filed a lawsuit for compensation.
Reba Jones filed the suit Sept. 14 in Berkeley Circuit Court against Jeans Interiors, Inc., doing business as Carpet World.
She says that on Oct. 2, 2004, she sustained severe and permanent injuries when a roll of carpet fell on her.
"The defendant failed to adequately guard against foreseeable falls from high storage racks of merchandise stored directly above customers on its premises," the complaint says.
Jones also blames Carpet World for failing to adequately inspect its premises and warn her of the dangerous condition.
Her injuries included an occipital contusion and cervical strain, the complaint says.
It adds that she has suffered great pain of body and mind and her ability to enjoy life has been greatly diminished. Economically, she says she has incurred "great expense" for medical care and has lost time at work.
She seeks compensatory damages and is represented by Stephen Skinner of Nichols and Skinner in Charles Town.
Judge Christopher Wilkes has been assigned the case.
