Joanne Hutchens and Randolph Hutchens vs. City of Martinsburg and CSX Transportation

* Joanne Hutchens claims she fell on Nov. 14, 2004, while walking along North Queen Street in Martinsburg, underneath a CSX overpass. She claims she caught her foot on pieces of broken and disrepaired sidewalk, fell and hit her face, causing a bloody nose, knee scrapes, broken glasses and dentures. The plaintiffs claim the defendants failed to follow city ordinances and keep the sidewalk repaired.

Antoinette Yates vs. Waste Management of West Virginia Inc.
PA - David Hammer; J - David Sanders
* Yates claims the defendant violated the West Virginia Wage Payment and Collection Act by terminating her employment with the company because she did not agree with the defendant's scheme to manipulate public opinion about the LCS Landfill's required capacity or the company's practice of falsifying drivers' records. Yates claims she was fired Oct. 19, 2004, and the defendant failed to pay all wages due to her within 72 hours of the termination.

Barbara A. Hoffmaster vs. Nathaniel Bland and Schewel Furniture Co. Inc.
PA - Mark Jenkinson; J - David Sanders
* Hoffmaster claims Bland and furniture company employees dangerously overloaded Bland's truck with large pieces of furniture on Dec. 17, 2005. Bland left the store and traveled onto Interstate 81, where the defendants' negligence caused the furniture to spill out of the truck into several lanes of traffic. Hoffmaster's vehicle and another vehicle collided because of the furniture, and the plaintiff incurred more than $88,000 in medical expenses following the accident.
