CHARLESTON - A Kanawha County woman says Charleston Area Medical Center is to blame for the death of her daughter, who passed away soon after being born.
Cindy Ann Cook filed a lawsuit Oct. 13 in Kanawha Circuit Court over the death of Haley Cook-Bishop. Doctors Douglas Harrison, Christos Hatjis, David Hernandez and West Virginia University's Board of Governors and CAMC are the defendants.
Cook says the facility failed to provide adequate care by not delivering the baby as soon as lung maturity was assured on March 30, 2004.
Cook-Bishop died April 4, and Cook says the doctors did not consider her previous history of stillbirth and diabetes.
Julie Garvin of the Masters Law Firm is representing Cook and the baby's father, Darrin Bishop.
Cook says that "the defendants did not properly (treat) resulting complications from which she suffered," and "was not timely diagnosed and/or treated, resulting in pain, suffering and ultimately the death of the infant Haley Cook-Bishop at birth."
The plaintiffs seek compensatory damages for the loss of companionship of their daughter and the loss of enjoyment of their own lives.
Judge Tod Kaufman has been assigned the case.
