WINFIELD – A Mason County woman says she was a victim of age discrimation by Rite Aid.
Connie Sue Stranahan filed a lawsuit against Rite Aid of West Virginia Inc. on Oct. 26 in Putnam Circuit Court.
In the complaint filed by Nitro attorney Thomas H. Peyton, Stranahan says she worked for Rite Aid from March 21, 1988, to April 24, 2005, when she was fired at age 54.
She says she was fired only because of her age and "any excuse offered by the defendant is merely a pretext for the defendant's age discrimination against the plaintiff," according to the complaint.
Stranahan says she has suffered aggravation, annoyance, inconvenience, past and future lost wages, humiliation, embarrassment, emotional and mental distress and loss of personal dignity. In addition, she says she has incurred significant attorney fees and court costs.
She seeks compensatory damages and, because she says the conduct was willful, wanton, reckless or in total disregard of her civil rights, punitive damages. She also asks the court to declare the actions of the plaintiff to be in violation of state law and to enjoin Rite Aid from doing it again and to participate in and/or implement an educational program.
The case has been assigned to Circuit Judge O.C. "Hobby" Spaudling.
