Salad dressing causes fall, suit says

CHARLESTON - A woman blames a St. Albans supermarket for not keeping its floor free from slippery substances and is suing over her alleged fall.

Cheryl Harris filed the suit Nov. 17 in Kanawha Circuit Court against Fas-Check Supermarket, seeking compensation for a fall she says she sustained July 13, 2005.

"While walking near the store's buffet island, Plaintiff slipped on an oily salad or pasta dressing which had not been cleaned up," the complaint says.

"As a result of slipping on this oily substance, the plaintiff fell to the floor. As a result of this fall, the plaintiff was seriously and permanently injured."

Robert H. Miller III of Sutter Law Firm in Charleston is representing Harris, who did not specify her injuries in the complaint.

She blames Fas-Check for not keeping its aisles in a safe condition, not inspecting and properly cleaning its floors, not keeping its aisles free from, failing to keep common areas in a safe condition, failing to warn the public of the spill and failing to clean up the dressing in a reasonable amount of time.

She seeks compensatory damages for pain and suffering and medical expenses.

Harris also says the defendant's actions warrant punitive damages.

Judge Jennifer Bailey Walker has been assigned the case.
