Whittaker didn't pay for carpet, suit claims

WINFIELD – Nearly four years ago, Jack Whittaker won the Powerball jackpot and became $314 million richer.

Now, a different kind of Instant Wealth has Whittaker named in yet another lawsuit.

Whittaker, his wife Jewell K. Whittaker and his company Diversified Enterprise Inc. are named as defendants in a lawsuit filed Nov. 22 in Putnam Circuit Court.

J&R Sales Inc., doing business as ESC Carpet, Tile &More, say the defendants owe $6,746.58 for carpet and carpet padding.

J&R says 57.67 yards of Mohawk Instant Wealth and 279.89 yards of carpet padding were installed at a home owned by the defendants at 115 Rosehill Acres in Scott Depot.

J&R says the money never was paid and that the defendants refuse to pay. It filed a mechanic's lien on Sept. 15.

J&R seeks compensatory damages. It is being represented by attorney David K. Schwirian.

The case has been assigned to Circuit Judge Ed Eagloski.
