HUNTINGTON - A woman says the Old Navy clothing store in the Huntington Mall failed to keep its aisles clean and caused her slip and fall.
Drema Watson is suing The Gap, Inc., doing business as Old Navy, in Cabell Circuit Court. She filed her suit Dec. 8.
The alleged incident occurred Dec. 18, 2004, and caused "nuisance and inconvenience," among other things, according to the complaint.
"Your defendant owed a duty unto your plaintiff as an invited guest of its business premises to keep its aisleways free of debris, in particular to this case the defendant's hangers for clothes, so that Plaintiff could use their premises in a safe manner," the complaint says.
It adds that Old Navy had a duty not to subject her to potential injuries. She charges the store with negligence.
Watson seeks compensation for medical expenses, emotional distress, loss of earning capacity, loss of enjoyment of life, nuisance and inconvenience.
Huntington attorney R. Lee Booten II is representing the plaintiff.
Judge David Pancake has been assigned the case.
