WINFIELD – A couple says a man has failed to repay the nearly $74,000 he borrowed from them.
Roger and Michele White filed the lawsuit Dec. 8 against Domenic Ripepi in Putnam Circuit Court.
In the complaint, the Whites says Ripepi, who lives in Ohio County and has lived in Pennsylvania, borrowed $73,946 from them on Jan. 7, 2005. He signed a promissory note to pay them back by April 1, 2005.
However, they say he failed to do so. He then told them he'd pay them back upon the sale of a home in Pennsylvania. But when he sold that home, Ripepi still didn't pay the Whites back, they claim.
They say they have tried numerous times to contact Ripepi, but they say he avoids contact with them to avoid paying the debt.
The Whites also allege that Ripepi bought a condominium in which he now lives and an automobile which he now drives, but they say those items are in his daughter's name to avoid his creditors.
The Whites say Ripepi is in breach of their contract and is guilty of fraud.
They seek compensatory and punitive damages, pre- and post-judgment interest, attorney fees, court costs and other relief.
The Whites are represented by attorney Robert W. Compton, and the case has been assigned to Circuit Judge O.C. "Hobby" Spaulding.
