WHEELING - An Ohio County woman says she tripped over an egg cart and is suing for her injuries.
Deborah Prager and husband Raymond filed the suit Dec. 11 in Ohio Circuit Court against Riesbeck's Food Markets in Wheeling.
The alleged incident took place Jan. 21, 2005.
"Prager was approaching the dairy cooler to retrieve a product when her foot hit an object obstructing her path, which caused her to fall on the floor in front of the cooler," the complaint says.
"After ... Prager regained her composure, she noticed that a movable cart stacked with dozens of eggs was directly in front of the cooler in question and a portion of the cart was uncovered or empty which was protruding out from the bottom of the cart, creating a dangerous condition."
Prager says she sustained injuries to her left arm and shoulder that required surgery to repair ligaments and tendons within her left rotator cuff.
The suit also says she has suffered pain of body and mind and an impairment of her capacity to enjoy life and ability to earn a living.
Her medical expenses, it says, have totaled $39,657.75, though she seeks $250,000.
