MORGANTOWN - An Ohio-based construction company based is suing a theater company, claiming the theater breached its contract and still owes the construction company money.
Continental Building Systems of Columbus, Ohio, filed the suit against Hollywood Theaters on Jan. 16. Continental claims the company was contracted by the theater to provide labor, services, equipment and materials for construction in Granville, W.Va. The suit states Continental provided a bill for $5,341,566.54, which the theater agreed to pay.
"Despite delivery of invoices for the materials and labor furnished and reasonable attempts to collect the amount owed from Hollywood Theaters, Hollywood Theaters has refused to make any further payment on the amount due and owning to Continental," the suit says.
At the time the suit was filed, Hollywood Theaters still owed $317,928 to Continental.
On Aug. 18, 2006, Continental recorded a Mechanic's Lien and further requests for payment.
"Hollywood Theaters has failed and refused to pay Continental the amount due for labor and materials supplied," the suit says.
Continental is seeking the remainder amount owed to them, with interest, together with fees and any other relief the court says is necessary.
