Marion woman sues waste company after accident

MORGANTOWN - A Marion County woman is suing BFI Waste Systems after she was injured in a car accident involving a vehicle owned by BFI.

Carol Bower was driving north on Interstate 79 on Jan. 14, 2005, at the same time Michael Powell was driving a garbage truck south. A tire became unattached from the garbage truck and struck the driver's side of the vehicle operated by Bower.

The collision caused Bower to be permanently injured and disabled as well as damaged her 2004 Toyota vehicle.

The suit maintains that BFI and Powell are negligent because the vehicle Powell was operating was not well maintained. As a result of the negligence, Bower sustained permanent physical injuries, pain and suffering, mental anguish, a diminished capacity to enjoy life and substantial medical expenses.

Bower also seeks compensatory damages for medical bills and court costs.

The case was filed Jan. 12 by Michelle Widmer-Eby, Bower's attorney.
