Employee blames mall store for injuries

CHARLESTON - A Kanawha County man has filed a lawsuit against his employer after he claims he was injured due to his job duties.

John G. Hicks filed a suit against The Bombay Company Inc. on Jan. 29 in Kanawha Circuit Court. Hicks was a store manager, employed by Bombay, which has a location in the Charleston Town Center mall. Part of his job duties required him to lift and move heavy merchandise, without assistance or appropriate safety equipment, on a regular basis.

On Jan. 30, 2005, Hicks was performing his job duties and was severely and permanently injured.

The suit says Bombay violated West Virginia Code in that it intentionally required Hicks to work under hazardous conditions without appropriate protection.

Hicks seeks compensatory damages from Bombay in as well as court costs.

The case has been assigned to Judge James Stucky.
