CHARLESTON - A Kanawha County woman blames a real estate company and the homeowners of a house she visited after she fell and injured herself on stairs at the house.
Doris Cowgill filed a suit Jan. 31 in Kanawha Circuit Court. She was visiting the open house of Kathy Schrader and Michael Levy, who were trying to sell their home through Old Colony Company.
During the visit, Cowgill slipped on a slippery substance located on the sidewalk stair and "fell violently," the suit says, resulting in several injuries, including a broken left distal fibula. Cowgill was hospitalized and had to undergo surgery.
The suit claims the homeowners were negligent because they invited potential buyers to the home and should have known about the slippery substance. The suit also says Old Colony has a responsibility to inspect the properties and keep them in safe condition.
Cowgill says she suffered from lost wages and medical bills. She seeks compensatory damages, both jointly and severally, plus interest and court fees.
She is being represented by attorney Kelly Elswick-Hall, and the case has been assigned to Judge Tod Kaufman.
