CHARLESTON - A Kanawha County couple has filed a suit against a national-chain pet store after a dog taking obedience classes in the Charleston store attacked the woman.
Violet and Lorren Wilson filed a suit Feb. 23 in Kanawha Circuit Court, naming PETsMART as the defendant. PETsMART is a pet supply store that also offers training and obedience classes, which are conducted on the retail floor space.
"The dogs and dog owners participating in the training and obedience programs offered by (PETsMART) are in close proximity to other shoppers ... inside their facility," the suit says.
On April 2, 2006, Violet Wilson was shopping at the store when she was attacked and bitten by a dog participating in the training and obedience program, suffering a serious injury.
The suit says the store was negligent because the animals were not properly restrained, and they posed a threat to the customers.
The Wilsons seeks compensation for medical bills and other pain and suffering.
Attorney Stephen L. Gaylock is representing the Wilsons, and the case has been assigned to Judge Tod Kaufman.
