HUNTINGTON - An Ohio man who was employed by CSX Transportation has filed a suit against the company, claiming substances he came in contact with while employed by CSX have cause serious illnesses.
Vernon Ellis, of Proctorville, Ohio, filed a suit March 12 in Cabell Circuit Court. He was employed by CSX from April 1963 to July 1995. The suit says Ellis was diagnosed with colon cancer and Parkinson's disease, which developed in the course of his work with CSX.
During his employment, Ellis was required to work with toxic substances, including asbestos-related products. The exposure caused Ellis to suffer severe, permanent and life threatening injuries.
The suit says that CSX violated the Locomotive Boiler Inspection Act, in that it failed to provide Ellis with a locomotive in a proper and safe condition, which caused his illnesses.
Because of his health, Ellis has been forced to incur medical bills to treat his condition.
His enjoyment of life has been taken away and he also suffered great pain, extreme nervousness and mental anguish, the suit says.
Ellis seeks judgment against CSX in a sum set by the court.
