Former manager says he owns part of clothing store

MORGANTOWN - A Monongalia County man has filed a lawsuit against the men's clothing store he managed.

Kelly Doyle filed a suit March 26 in Monongalia Circuit Court, naming Saul Radman and Daniel's Men's Store as defendants.

The suit says Doyle was the manager of the store for a number of years. In 2005, he agreed to acquire stock of Daniel's. The suit says that as part of the agreement, one-third of the stock was transferred to Doyle.

However, for various reasons, Doyle and Radman were unable to reach a final agreement for the purchase of the remaining share of stock of the store, the suit says.

Doyle then was fired from his job and claims he is not aware of any stockholder's meetings in the last two years.

"The individual in control of the corporation, Daniel's, have acted, are acting, will act in a manner that is oppressive to the stockholders," the suit says.

The suit says that the company failed to provide Doyle with the proper information he needed to file his 2006 income tax return, in regard to his share of the profits.

The suit also says that if the books and records of the company do not reflect Doyle as a stockholder, then Radman shall be responsible and liable because of his capacity to transfer the stock to Doyle.

Doyle, through attorney Thomas W. Kupec, seeks that is one-third interest in Daniel's Men's Store be recognized and that the store be dissolved and that Doyle should recover one-third net profit.
