* The plaintiffs claim there is a danger to their building in the form of a falling wall that has massive backfill behind it. The city is threatening condemnation of the building. However, as the wall was constructed by the city circa 1969, it is the city, and not the plaintiffs who have a responsibility to repair the wall. Also, the plaintiffs claim that the Kuehn's vehicles have contributed to the crumbling of the wall and the landfill. They are seeking a temporary restraining order against the city and the code department, a Writ of Mandamus compelling the city to repair the wall, as well as compensatory and punitive damages from all parties.

* Frederick claims Jane Dow negligently operated Huffman's vehicle so as to collide with his own automobile, causing him serious bodily injury and trauma. *Bossio claims that, in violation of his lease, Mayer failed to repair a broken gas line leading to the property. Mayer left the premise without heat and hot water, which caused several water lines to freeze then burst and subsequently damage the property. This has caused Bossio to lose rent money since Jan. 1, 2007. He is seeking compensatory damages, loss of rent, repair of the water lines, cleanup costs, punitive damages, as well as all other costs and attorney fees.

* Garcia claims that despite paying the sum of $40,000 to Konchesky in an Agreement for the Purchase & Sale of Real Estate, Konchesky has failed to convey the property title, free and clear of liens and encumbrances, to the plaintiff. Despite repeated requests that the money be returned to him, Konchesky has failed to comply. Garcia is seeking $40,000 as well as interest, costs and attorney fees.
