MARTINSBURG - A Berkeley County woman has filed a suit against the owners of a dog that attacked her four-year-old daughter.
Kristen Kreuz filed a suit March 20 in Berkeley Circuit Court against Dan and Cathy Fogle.
The suit says the Fogle's mixed breed Dalmatian, Snoop, attacked Kreuz's daughter, Allison Fournier, who was 3 years old at the time.
According to the lawsuit, Fournier was attacked at her home by the dog, who was "running at large." The suit says the attack occurred without any provocation on part of the child.
The suit says the Fogles have a responsibility to restrain their dog, which they did not do, causing Fournier to be attacked and bitten.
Kreuz seeks compensation against the Fogles for her child's injuries and medical expenses and whatever else the court deems necessary.
The case has been assigned to Judge David Sanders.
