* The plaintiffs claim that Joshua Tomblyn, while on duty and acting within the scope of his employment with the West Virginia State Police, negligently failed to yield the right of way, causing a collision with the plaintiffs' vehicle. * Steketee claims the defendants are responsible neglecting to provide adequate medical care for participants injured during their sponsored triathlon competition. Steketee claims that she cut her foot while stepping into the Monongahela River, which, she claims, was at the time unreasonably contaminated for the purposes of swimming. She claims that the infection that developed from her cut was a result of this contamination as well as due to a lack of medical treatment available at the competition. Steketee has been seriously injured, both physically and psychologically.
