Man says he was fired because of his age

MARTINSBURG - A West Virginia man has filed a lawsuit against his previous employer, claiming he was fired because of his age.

James D. Stuckey filed a suit April 17 in Berkeley Circuit Court, against Essroc Cement Corp. and Harvey Hyde, a manager for Essroc.

Stuckey, who was employed by Essroc from January 1979 to December 2006, claims he was fired because he was 49. According to the suit, Essroc claims Stuckey was fired because of poor performance, but Stuckey claims he was fired because of his age, the suit says.

Stuckey, through his attorney Barry Beck, seeks unpaid wages, liquidated damages and court costs.

The case has been assigned to Judge Christopher Wilkes.
