Woman says Arby's manager hit, wrongly fired her

WHEELING - An Ohio County woman has filed a suit against the manager of the restaurant where she worked, claiming he hit her and wrongfully fired her.

Melissa Moore filed a suit against May 1 in Ohio Circuit Court against Scott Welling, a manager of the Arby's Restaurant in Elm Grove.

According to the suit, in May 2005, Welling started joking with Moore, acting as if he was going to lasso her with a rope. Moore allegedly responded by joking verbally with him. The suit says Welling lost his temper and started hitting her left arm with the rope.

Moore showed the mark from the rope to her shift manager and a co-worker, and told them what happened.

"On a following day in May, 2005, Scott Welling fired Melissa Moore," the suit says. "At the time he fired her, he physically pushed her."

According to the suit, the battery and wrongful termination is a violation of the West Virginia Human Rights Act.

Moore, through attorney Ronald Kasserman, seeks compensatory and punitive damages.

The case has been assigned to Judge Martin Gaughan.
