* Joseph, a tow truck driver for Midnight Auto Repair, was attempting to tow a disabled vehicle on Interstate 79 South operated by Brian Gibson. Holden, approaching in a 2005 Dodge Caravan, lost control of his vehicle, and struck Joseph as he was hooking the Gibson's vehicle to the tow truck. As the injuries suffered by Joseph are disabling and permanent, he seeks damages for personal injuries, past and future medical costs; past and future pain and suffering; loss of consortium; past and future ability to enjoy life; court costs and attorney fees. Joseph's wife Charlene also seeks loss of consortium.

* On May 25, 2005, while working with the West Virginia Courtesy Patrol and assisting a tow truck driver in hooking up a disabled vehicle, a 2005 Dodge Caravan driven by Holden struck Roy Fancher. Fancher died as a result of those injuries on May 26, 2005. As administrator of the estate, Raymond Fancher is seeking compensatory and punitive damages as well as interest on general damages.
