Mother files wrongful death suit for son's children

MORGANTOWN - The mother of a man who died in a house fire has filed a suit on behalf of his children, seeking damages under the West Virginia Wrongful Death Act.

Ruth N. Michael filed a suit May 18 in Monongalia Circuit Court, on behalf of James Andrew Michael II and Jeanacatherine Isabella Michael, the children of her deceased son, James A. Michael.

The suit names Michelle Michael and State Farm Fire and Casualty Company as the defendants. According to the suit, Michelle Michael caused the fire that killed James Michael.

According to the suit, James Michael was killed Nov. 29, 2005, in a fire at 545 Killamey Drive in Morgantown. Ruth Michael, the guardian for James Michael's children, claims the children are entitled to damages allowed under the West Virginia Wrongful Death Act and West Virginia Law.

Ruth Michael, through attorney J. Bryan Edwards, seeks compensatory and punitive damages from Michelle Michael, who is insured under a State Farm Fire and Casualty Company policy.
