Berkeley woman sues after fall at Lowe's

MARTINSBURG - A Berkeley County woman has filed a suit against a national home improvement store, claiming she was injured when she fell.

Mable Viola Jackson filed a suit May 24 in Berkeley Circuit Court, against Lowe's Home Centers Inc.

Jackson claims she was visiting the Martinsburg Lowe's on May 28, 2005, when she tripped and fell on the handle of a cart holding flowers.

"The cart handle was designed to be hooked to the cart out of the way of customers, but the cart in question had a broken handle and was not hooked to the cart thereby protruding out and into the sidewalk where it presented a trip hazard to customers," the suit says.

As a result of the fall, Jackson suffered injuries to her neck, left arm, lower back and left leg.

Jackson claims the store owed her a duty to make sure she was in a safe condition.

Jackson, through attorney Harry P. Waddell, seeks compensatory damages. The case has been assigned to Judge Christopher Wilkes.
