Woman says Harbor Freight Tools wrongfully fired her

CHARLESTON - A Kanawha County woman has filed a suit against her previous employer, claiming she was unlawfully terminated.

Tonyia Miller filed a suit May 31 in Kanawha Circuit Court against Harbor Freight Tools USA Inc. and Steven Stewart. Miller claims she was fired because her age was perceived as a disability.

According to the suit, Harbor Freight employed Miller for about five years. During that time, she claims she performed her duties in a satisfactory manner, yet she was fired March 3, 2007.

In a five-count suit, Miller claims she was fired because of her age, which is a violation of the West Virginia Human Rights Act.

Miller seeks damages, including lost wages and benefits, back pay, front pay, punitive damages, court costs, and other relief.

Attorney Mark A. Atkinson is representing Miller, and the case has been assigned to Judge Tod Kaufman.
