CHARLESTON - A Kanawha County man has filed a personal injury suit against West Virginia American Water Company and the town where he lives.
Charles Duane Thomas, a St. Albans resident, filed a suit May 31 in Kanawha Circuit Court, claiming negligence by the water company caused him to be injured.
According to the suit, Thomas was walking in his yard on June 3, 2005, when he "stepped on a metal cover that had not been properly tightened, which flipped open," causing Thomas to fall and be injured. He claims an employee of the water company had opened the cover.
Thomas claims West Virginia American Water and its employees should have known of the danger caused by not properly tightening the meter covers.
As a result, Thomas suffered severe injuries and medical expenses. He seeks compensatory damages.
Attorney Phillip M. Stowers is representing Thomas. The case has been assigned to Judge James Stucky.
