Braxton man says former employer discriminated, fired him

MORGANTOWN - A Braxton County man has filed a suit against his former employer, claiming he was discriminated against and fired.

Don A. Flint filed a suit May 31 in Monongalia Circuit Court against Trimble Engineers and Constructors Inc., Daniel Flesher and Matthew Flesher. Daniel Flesher is the owner of Trimble Engineers and Constructors.

Flint claims he was employed by Trimble for more than 10 years. During that time, he claims in the suit that he performed his duties in a satisfactory manner, yet he was fired Nov. 22, 2005.

Flint claims his termination is in violation with West Virginia Code and that he has suffered indignity, embarrassment, humiliation and emotional distress.

In the five-count lawsuit, Flint also claims he was assaulted by Matthew Flesher. Flint claims Matthew Flesher assaulted his with a beer bottle, causing extreme pain and permanent physical injuries.

As a result, Flint seeks lost wages and benefits, back pay, punitive damages and other relief.

Attorney Mark A. Atkinson is representing Flint. The case has been assigned to Judge Russell M. Clawges Jr.
