Woman blames grocer, car wash for injuries

CHARLESTON - A Kanawha County woman has filed a suit against a local grocery store as well as a car wash, claiming she was injured on property owned by the two businesses.

Almeta Neville filed a suit June 7 in Kanawha Circuit Court against the Kanawha City Foodland and Mountaineer Pride Car Wash.

On Dec. 24, 2005, Neville claims she was with her son, Randy Neville, when he took his car to Mountaineer Pride Car Wash to have it washed while he and mother shopped at Foodland.

"As was the normal custom and practice of Mr. Neville with the Mountaineer Pride Car Wash employees, Mr. Neville left his car and the keys to the car with the Mountaineer Pride Car Wash employees to wash the car and then place the car on the Kanawha City Foodland parking lot for the Nevilles to retrieve when they were done grocery shopping," the suit says.

As her son was paying for the car wash, Almeta Neville began walking to Foodland. While walking down an incline from the front of the wash bay, which was a normal route for customers, Neville suddenly fell on black ice and fell violently to the ground, the suit says.

According to the suit, the area where Neville fell is owned by Foodland and Mountaineer Pride Car Wash. Neville claims the area was negligently kept, causing the dangerous conditions.

Almeta Neville, through attorney R. Ford Francis, seeks compensatory damages. The case has been assigned to Judge Irene Berger.
