CHARLESTON - A Kanawha County man is seeking $150,000 in damages after he was injured when he fell down some steps.
Larry Myers filed a suit June 11 in Kanawha Circuit Court against Capitol City Broadway Inc. and Doran Frame, the owner of the building.
According to the suit, Myers was a customer in the retail establishment owned by Capitol City Broadway when he fell down the steps of the front entrance.
Myers claims he fell because "the steps were too steep, no outside handrails were provided, no center handrails were provided, no warnings were posted at the top of the steps, the steps were not painted," and several other conditions, the suit says.
Myers fell to the bottom of the steps, and was injured. He claims he received physical and physiological damages, which required medical treatment.
Myers, through attorney Harold S. Albertson Jr., seeks compensatory and punitive damages in excess of $150,000.
The case has been assigned to Judge Paul Zakaib.
