MARTINSBURG - A Berkeley County man has filed a suit against a local business, claiming he fell and was injured while performing business.
Lanny S. Hensler filed a suit June 19 in Berkeley Circuit Court against Opequon Motors Inc.
According to the suit, Hensler went to Opequon Motors on March 19, 2007, when he fell on ice that had accumulated due to a defective gutter or downspout.
Hensler claims the ice was a hidden danger, trap, snare, pitfall or the like. He also claims Opequon was negligent in allowing the ice to accumulate. Hensler said he has lost wages and incurred medical expenses, for which he wants to be compensated.
He seeks compensatory and punitive damages.
Attorney Terrance L. Britt is representing Hensler. The case has been assigned to Judge Gray Silver.
