Man sues Arby's after incident in parking lot

HUNTINGTON - A Kanawha County man filed a suit against a national fast food restaurant, after he was injured when he was in the restaurant's parking lot.

William C. Wisecup filed a suit June 21 in Cabell Circuit Court against Arby's.

Wisecup claims he went to the Barboursville Arby's on June 23, 2005, and bought a beverage through the drive-through. He then pulled into a parking spot to let his dog walk in some grass along side the parking lot.

"Within two steps of departing his vehicle, he stepped in an open space between two grates covering a drainage ditch, causing his left leg to go down into the ditch and severely torquing his right leg and knee," the suit says.

Because of his injuries, Wisecup had to have an arthroscopy chondroplasty and arthroscopy meniscectomy. He claims he has incurred medical expenses and has had to go through 20 session of physical therapy, as well as resign from his position as a golf coach at a local high school. He claims he has also lost wages.

Wisecup, through attorney Marshall C. Spradling, seeks compensation for his damages.

The case has been assigned to Judge David Pancake.
