CHARLESTON - A Kanawha County woman has filed a lawsuit against an owner of the Executive Air Terminal at Yeager Airport, claiming he sexually assaulted her on a plane her husband was piloting.
Lisa and Mike Thomas filed a suit June 27 in Kanawha Circuit Court against Brian Scott Miller and Executive Air Terminal Inc. after Miller allegedly inappropriately kissed and touched her.
According to the suit, Miller, who is half owner of Executive Air, and Mike and Lisa Thomas were on a flight Jan. 27, 2007, from Myrtle Beach, S.C., to Charleston. Lisa Thomas is a volunteer employee of Executive Air.
Thomas claims Miller physically touched her in an unwanted way, including a kiss on the mouth, and verbally propositioned her for sexual favors.
"Lisa Thomas was unable to thwart the physical touching of (Miller) due to the confined space of the aircraft," the suit says.
The Thomas' claim Miller violated the West Virginia Human Rights Act. In a five-count suit, Mike and Lisa Thomas seek a permanent injunction against Executive Air Terminal Inc., ordering an ongoing training program on sexual harassment in the workplace.
They also seek compensatory and punitive damages in an amount to be determined by a jury.
Attorney Mark L. French is representing the Thomases. The case has been assigned to Judge Irene Berger.
