Backed-up sewer, broken back lead to lawsuit

MARTINSBURG - A Berkeley County woman has filed a suit against the City of Martinsburg after she broke her back when she slipped on sewage that had backed up in her house.

Dixie Hager filed a suit June 28 in Berkeley Circuit Court, claiming the city was negligent in keeping its sewer system, open, in repair and free from nuisance.

According to the suit, sewage repeatedly backed into Hager's basement, including Nov. 29, 2005. On that day, Hager went to the basement and slipped on the wet floor, fell and fractured her spine.

She was hospitalized and required nursing home care. Hager claims she incurred medical expenses of more than $77,000.

Hager, through attorney Harry P. Waddell, seeks compensatory damages, plus interest for her injuries.

The case has been assigned to Judge David Sanders.
