MARTINSBURG - A Berkeley County couple have filed a suit against a driver of Schwan's Food seeking $25,000 because they claim he broke their agreement and cashed three of their checks at once.
Robert and Mary Bryson filed a suit July 12 in Berkeley Circuit Court against Brendon Connelly. According to the complaint, the Bryson's claim they had a verbal agreement with Connelly to write post-dated checks and he would deposit them one at a time at the end of every month.
The Bryson's claim they are on disability and get paid at the beginning of every month. The suit says they must budget because they have three children.
"Mr. Connelly broke his agreement and deposited the last three checks, which has destroyed my family financially," the suit says.
The suit claims Connelly disregarded company policy and released personal and confidential information to people outside of Schwan's Food Company, which "is not exceptable [sic] by any means as well as illegal," the suit says.
The Bryson's seek $25,000 in compensation for punitive damages, slander, defamation of character and fraud.
They also filed a separate suit against the supervisor of Schwan's Food, Chris Stoner. According to the suit, the Bryson's claim Stoner was negligence in his position by allowing Connelly "to do what ever he wishes with disregards to company policy."
The Bryson's also seek $25,000 in damages from Stoner.
They are representing themselves in both cases. The Connelly case has been assigned to Judge Christopher Wilkes, and the Stone case to Judge David Sanders.
