Woman sues after tripping while going to play slots

MARTINSBURG - A Berkeley County woman has filed a suit against a local business after she tripped on an unmarked step going down in the slot machine parlor.

Frances Gum, with her husband Lawrence Philip Gum, filed a suit July 13 in Berkeley Circuit Court against State Line Market, which operates as a grocery store, bar and slot machine parlor.

According to the suit, Frances Gum went to the store Sept. 28, 2006, with a friend.

"Frances, when entering into the darkened slot machine parlor, missed a step leading down into the slot machine parlor, which step was not illuminated, or marked in any way, and fell and grievously injured herself," the suit says.

Gum claims State Line Market knew of the danger posed by the unilluminated step and failed to remedy the condition.

According to the suit, Gum has lost the ability to enjoy a normal and productive life. Philip Gum claims he has been deprived of the society, companionship, consortium and services of his wife.

Frances and Philip Gum seek unspecified compensatory damages.

The case has been assigned to Judge David Sanders.
