* The plaintiffs claim Gerald Gregory was severely injured on Sept. 30, 2005, when another employee at Orgill's Martinsburg plant struck Gregory with a forklift. The plaintiffs claim the defendant created an unsafe working condition and knowingly permitted the use of fork-lifts that were repeatedly driven at high rates of speed and overloaded to obstruct the view of operators. The plaintiffs are seeking an amount of relief to be determined in trial.

The City of Martinsburg vs. Wayne Stokes

* The city claims Stokes home has been in disrepair since before March 2004, when water service was terminated because the defendant refused to make repairs and stop plumbing leaks. In 2006, the city claims Stokes continued to live in the home, and the city police department received complaints that Stokes was disposing human waste in a trash can in front of the house. The property was condemned in September 2006. The city sought an injunction to prevent the unlawful occupancy of Stokes' home until the property is certified as habitable, and the injunction was granted Aug. 14.
