CHARLESTON - The widow of a Wayne County man who died from lung cancer has filed a suit against 39 companies, claiming her husband's exposure to asbestos on the job caused his disease and ultimate death.
Charlotte Anne Warren of Ceredo filed a suit Aug. 16 in Kanawha Circuit Court on behalf of Jerry Allen Warren who died Jan. 27, 2007. Attorney David B. Richardson is representing Warren.
According to the suit, Jerry Warren, who smoked one pack of cigarettes a day from 1950 to 1993, died of lung cancer. He worked as a utility man at Owens-Illinois in Huntington, and a laborer, mechanic, and operator at the Armco Steel plant in Ashland, Ky., from 1955 to 1997.
Charlotte Warren claims her husband was exposed to asbestos dust and fibers while working in the plant, because of the use of pipe insulations, pipe and cement finishing products, building insulations and gasket materials, and other products that contained asbestos.
Warren also claims A.K. Steel and Owens Illinois failed to provide adequate inspections and supervision in regard to the use of asbestos, creating an unsafe working condition.
According to the suit, Warren claims she loss the general services, companionship and society of her spouse.
In a 10-count suit, Warren seeks compensatory and punitive damages.
The case will be assigned to a visiting judge.
