Woman sues Fifth Quarter, Beni Kedem over parking lot fall

CHARLESTON - A Kanawha County woman has filed a suit against a local temple and a restaurant after she was injured when she fell in a parking lot between the two buildings.

Cahela Crouch of Dunbar filed a suit Sept. 10 in Kanawha Circuit Court against Fifth Quarter and the Beni Kedem Shrine Temple.

According to the suit, filed by attorney Andrew L. Paternostro of the Charleston law firm Bell & Bands, Crouch was going to a meeting at the temple and parked in the Fifth Quarter parking lot, which is owned by Beni Kedem.

Crouch claims the parking lot had eroded, leading to a pothole about 10 inches wide by 2 inches deep. Crouch stepped in the hole and fell, fracturing her pelvis and a wrist.

According to the suit, the parking lot was not maintained in a reasonably safe manner, which made it a danger to restaurant patrons and other persons using the lot.

Crouch claims she required medical care, including surgery and five days of hospitalization. She suffered medical expenses, hospital charges and physician's charges.

Crouch, through Paternostro, seeks compensatory and punitive damages.

The case has been assigned to Judge Charles King.
