CHARLESTON - A woman who tripped over the entrance of the West Virginia Workers' Compensation Division has filed a suit against the owner of the building.
Nancy Sue Payne filed a suit Sept. 13 in Kanawha Circuit Court against Real Estate Resources and General Corporation.
Jane Cline, the Insurance Commissioner of the State of West Virginia, is also named as a defendant.
According to the suit, Payne went to the Charleston office Sept. 14, 2005, and tripped over a "negligently maintained floor surface" at the entry of the office.
She claims she suffered severe injuries.
According to the suit, the defendants failed to control the floor surface and failed its duty to Payne.
Payne claims her injuries are permanent and lasting in nature, and she suffered great pain of body and mind. She claims she has suffered a loss of her ability to carry out her normal daily activities and to enjoy life in general.
According to the suit, Payne suffered various expenses, including transportation costs to hospitals, medical attention and other medical care.
Payne, through attorney Larry L. Rowe, demands judgment from the defendants to fully compensate her for her injuries.
The case has been assigned to Judge Paul Zakaib.
