Cabell man sues Huntington for sidewalk fall

HUNTINGTON - A Cabell County man has filed a suit against the City of Huntington after he fell on a sidewalk after leaving a fast food restaurant.

Grover Lewis filed a suit Sept. 6 in Cabell Circuit Court against the city.

According to the suit, Lewis was leaving the McDonald's on Washington Avenue after eating breakfast when he fell on broken pavement on the sidewalk.

"The sidewalk was broken, portions projecting upward and downward with grass growing in the defective portions," the suit says.

Lewis claims the fall caused broken facial bones, fractured teeth, lacerations, contusion and abrasions of his body and extremities.

According to the suit, Lewis suffered a loss of enjoyment of life, emotional distress and shame at his facial appearance. He seeks compensatory and punitive damages.

Attorney James E. Spurlock is representing Lewis. The case has been assigned to Judge John L. Cummings.
