Maryland woman sues Charles Town track for injuries from broken chair

Charles Town Races and Slots in Jefferson County.

CHARLES TOWN - A Maryland woman has filed a suit against the gaming venue in Jefferson County, claiming she was injured when the chair she was using broke.

Beatrice Caplan, along with her husband, Melvin Caplan, filed the suit Sept. 14 in Jefferson Circuit Court against PNGI Charles Town Gaming, LLC.

According to the suit, the Caplans were at the Charles Town Races and Slots on Sept. 16, 2006, to visit the casino. Beatrice Caplan drove, and her husband, who is blind, rode with her.

Beatrice Caplan was sitting in a chair while playing a slot machine, and the chair broke, causing her to fall.

Caplan broke her hip and was taken to the hospital. After her surgery and a four-day hospitalization, she was taken to Lorien Columbia Nursing and Rehabilitation Center, where she remained for nearly six weeks. Since her discharge there, she has been a resident of Harmony Hall Assisted Living in Columbia, Md.

"Since the accident, Mrs. Caplan has been unable to return to her home of 48 years, nor has she been able to return to living independently," the suit says.

Melvin Caplan claims he has been deprived of his wife's services, consortium and society.

The Caplans seek compensatory and punitive damages.

Attorney Andrew Skinner is representing the Caplans.
